1. Acceptance of Terms
By accessing or using Carified (“the Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.
These terms constitute a legally binding agreement between you and Carified Pty Ltd (ACN pending). Use of the Platform constitutes your acceptance of all terms outlined here.
2. Eligibility
To use the Platform you must be at least 18 years of age and be a resident of Australia. By registering an account, you represent and warrant that you meet these requirements.
If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these terms, and all references to “you” include that entity.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@carified.com.au if you suspect unauthorised access to your account.
You agree not to create multiple accounts, transfer your account to another person, or use another person's account without their permission and our consent.
4. Listings
All vehicle listings must be accurate, complete, and compliant with Australian Consumer Law. Sellers are required to disclose all known defects, modifications, and relevant history. By publishing a listing, you warrant that:
- You are the legal owner of the vehicle or have authority to sell it.
- All information provided, including photos, descriptions, and documents, is truthful and not misleading.
- The vehicle is free of any undisclosed encumbrances or financial interests.
- All required documents (PPSR, service history, etc.) attached to the listing are genuine.
We reserve the right to remove any listing that violates these terms without notice.
5. Prohibited Conduct
You must not use the Platform to:
- Post false, misleading, or fraudulent listings or communications.
- Harass, threaten, or abuse other users.
- Attempt to circumvent identity verification or any other security measures.
- Scrape, harvest, or collect data from the Platform without our written consent.
- Introduce malware, viruses, or any other harmful code to the Platform.
- Conduct transactions off-platform to avoid fees or to defraud another user.
- Use the Platform for any unlawful purpose, including but not limited to money laundering or vehicle rebirthing.
6. Intellectual Property
All content on the Platform — including logos, design, text, and software — is owned by or licensed to Carified. You may not reproduce, distribute, or create derivative works without our prior written consent.
By uploading content (photos, documents, descriptions) to the Platform, you grant Carified a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for operating and promoting the Platform.
7. Limitation of Liability
Carified is a marketplace and does not take part in transactions between buyers and sellers. We do not guarantee the accuracy of listings, the condition of vehicles, or the conduct of users.
To the maximum extent permitted by law, Carified will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any transaction conducted through it.
Nothing in these terms limits liability that cannot be excluded under Australian Consumer Law, including any applicable consumer guarantees.
8. Termination
We may suspend or terminate your account at any time if we believe you have violated these terms, engaged in fraudulent activity, or pose a risk to other users or the integrity of the Platform.
You may close your account at any time via the account settings page. Termination does not affect any obligations arising prior to the date of termination.
9. Governing Law
These terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these terms.
10. Changes to Terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, where changes are material, notify registered users by email. Continued use of the Platform after changes are published constitutes your acceptance of the updated terms.
